These Terms of Service (“Terms”) govern your use of the PolySpeak mobile application
(package name com.koala.translator, the “App”) and related materials on
https://xfye.polyspeakbb.com/.
By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. License
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control for lawful purposes. You may not copy, modify, distribute, reverse engineer, or create derivative works of the App except to the extent permitted by applicable law.
2. The service
PolySpeak provides translation features including text, voice, camera/OCR, conversation-style translation, document (.txt) translation, and local history. Online translation may use a Google translation endpoint; offline translation may use on-device ML Kit models. Features depend on device capabilities, permissions, network availability, and downloaded language packs.
3. No warranty on translation accuracy
Translations are provided for convenience on an “as is” and “as available” basis. We do not warrant that translations are accurate, complete, or suitable for any particular purpose (including legal, medical, financial, or safety-critical use). You are solely responsible for verifying important content.
4. Acceptable use
You agree not to:
- use the App for unlawful, harmful, or abusive purposes;
- attempt to disrupt, overload, or interfere with translation services or related infrastructure;
- misrepresent the App’s output as certified or official translation;
- circumvent regional availability restrictions built into the App.
5. Regional restrictions
The App may be unavailable in certain regions, including mainland China (CN) and Iran (IR), based on a local device country check. We may update restricted regions over time.
6. Third-party services
The App relies on third-party and platform components (including Google translation endpoints, ML Kit / Google Play services, and Android speech recognition). Your use of those components may also be subject to the third party’s terms. We are not responsible for third-party service outages or changes.
7. Intellectual property
The App, including its name, branding, and software, is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks except as needed to identify the App.
8. Disclaimer of warranties
To the fullest extent permitted by law, the App is provided without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, PolySpeak and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business, arising from your use of the App. Our aggregate liability for claims relating to the App shall not exceed the amount you paid (if any) for the App in the twelve months before the claim, or USD 10 if the App was free.
10. Termination
You may stop using the App at any time by uninstalling it. We may suspend or terminate access to the App or specific features if you violate these Terms or if we discontinue the product.
11. Governing law (placeholder)
These Terms are governed by the laws of the jurisdiction in which you reside, without regard to conflict of law principles, unless a different governing law is required by mandatory consumer protection rules. This clause is a placeholder until a formal publishing entity and preferred jurisdiction are designated; update this section when your legal entity is finalized.
12. Changes
We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the App after changes constitutes acceptance of the updated Terms.
